depends on what kind of kissing. a kiss on the cheek or a peck on the lips doesn’t really qualify as “sexual”, and thus would be safe and wouldn’t get the action tag. Full on mouth to mouth frenching, though, is not safe and would qualify for the tag.
Basically, what I’m saying is if the official description for the “human on pony action tag” begins with “sexual acts”, then that automatically means it can’t be a safe image. because sexual acts are not safe.
Even for kissing? A human kissing a pony would be Human On Pony Action, right? There’s tons of safe kissing pics.
given that definition, then it can’t be a safe rated image. Safe and Human On Pony Action are mutually exclusive tags.
so you have to pick one.

It largely depends on the context. For an image like this, especially with Lyra’s fanon erm, interest in humans, I’d say it’s entirely up to the artist whether this counts.
