Copyright law says that unless you defend your copyright, you’re giving consent to it being used as fair use.  
Which is fucking stupid, but as sue-happy a country the US is, it doesn’t surprise.

Copyright law really should be less strict. Maybe something along the lines of as long as you don’t claim to own the things you’re imitating and say that you don’t own it our have association with it. I know that is part of copyright law now but I mean with that being the majority of copyright law instead of a small part. Another good idea would be where things similar enough to an original work and labeled as an “imitation”

The reason you hire specialist firms like that is because you don’t have the in-house expertise to do it yourself. Yes, it would have been nice if Hasbro had told the firm, “FiM is special; there’s a heck of a lot of fan content and we want to encourage that. Use extreme discretion with it and run questionable decisions by us first.” But I would assume they didn’t think the specialists they hired would be clueless enough to do that in the first place.

I hate when companies fail to take responsibility, or just plain ignore and let roam freely, the smaller companies they have set to assist them. The reason Hasbro employed them in the first place was most-likely because they had the money and would rather a legal team write C&D’s for them. What they should have done is made them a “look-for list” in which details what is not alright and what is alright. Because it was art, I don’t believe any C&D is necessary, considering Jan wasn’t officially making any money off his animations AND the animations did not use any 2d models created by Hasbro.
 
Something that would be on the “look-for list” however, would be the profit portion. If it can be confirmed that they person makes a profit off of Hasbro’s work, then I would consider a C&D okay. However, I wouldn’t make this possibly for things that’re fan-made without any help from Hasbro, considering anyone can make art, and since plushies and such are considered art, I would say that making money off them is just fine. I believe Hasbro just get’s angry because they can’t hire someone or another company to make them as well as some fans do. I mean, I don’t want to buy a plushie that’s kinda shit, so I go for a fan-made one with tons of accuracy.
 
If hasbro wants to make money, they should consider contacting fans who they give C&Ds to. A fair deal, in my opinion, would be, “Give us 20% of the profit and you’re good to go.” I don’t think Hasbro needs much money. They’re like Valve.

It’s not really. Hasbro employed that company, and most likely still employ them. Their ineptitude, idiocy and blatant disregard for what’s best for Hasbro and “the fans” is still Hasbro’s responsibility.

So the C&D was done by a third-party legal company without Hasbro’s consent or knowledge, and now Hasbro is actively working with Jan to come up with a solution that will make everyone happy.
 
So all of that screaming and fan-rage was completely misdirected and entirely pointless.
