If some dope hadn’t got overenthusiastic about it, the project might have got near enough to completion that it could have been taken the rest of the way by any competent developer instead of the bodged half-a-game of that “Tribute Edition”.

For the purposes of this discussion, Starswirl doesn’t count as they were politely asked to change character names instead of being shut down. The card game was ripping off MLP and MTG, and we got an official one out of the deal anyway.
 
My point is there are far more completed/near complete fan games out there than C&D’d ones. It’s a publicity issue more than anything else. There are very few fangames that can reach the level of completeness and popularity that something like Fighting Is Magic achieved, and NOT get hammered down by corporate lawyers. That goes for just about any fandom/licensed property. Hasbro has been and continues to be remarkably lenient with MLP fan content, especially compared to other companies like Nickelodeon and Disney.

Starswirl Academy wasn’t C&D’d, but they were asked to change the names. Also that card game that fans had been working on for a while got shut down to pave the way for the official one.

People continue to realize that open source is a reliable method to avoid effective C&D. No open-source project has ever successfully been destroyed in that way to my knowledge. But people are too control-freaky to want to do open source sometimes.
