As for my personal opinion. I really don’t care much about LPs. If this were Nintendo going “takedown crazy” and actually removing videos, I can understand the anger. but I think they have a right to claim what’s legally theirs.
Ocarinaplaya, the guy who made those Doctor and the Assistant animations wanted me to utilize my skills at making a custom intro using the “clean”, title free Doctor Who intros. When I made it and he tried incorporating it, at first it was blocked completely, but after some editing, I got it up, but it was still ID’ed for revenue. And he told me “I deserve to make money for my work” and ended up not using it.
I’m just flabbergasted by that sense of arrogance and self-entitlement. In other words, I find it funny that people are citing Nintendo for being greedy, when I think it’s the LP’ers that are being greedy for making money of something that is essentially not theirs.

Except for, no matter what, that movie is going to start and end the same way, everytime. That’s why that warning is there. The only experience you can have with a movie is to watch it. With a game, nobody’s going to do the same exact thing. Some may go for a stealth run while others go for a run & gun approach, for example.
If you’ve watched TB’s video on it, you basically know all I’m gonna say about it.
The only difference between a video game and a sport is physical. Look at games like Starcraft. Or Dwarf Fortress. Or even CoD, to a lesser extent. Some games take loads of skill to play well. And you can’t even say that Dwarf Fortress takes less learning than playing any kind of sport.
Art commissioning is also using copyrighted material for your own gain, depending on what it is you’re being commissioned to do.
For me it’s because Lets Plays are basically doing DVD commentary over you playing a video game, a task that doesn’t require as much skill or learning as something like playing sports (physical) or web design (higher education). Plus there’s the fact you’re using a copyrighten product made by others for your own personal gain. You didn’t make the game, and the fact you own a copy of it doesn’t make the intellectual property yours for monetary gain. You know how videos always had that warning saying that they weren’t meant for exhibition purposes? Well this is the same thing more or less.
Minecraft is as big as it is because of Let’s Plays. Notch has said this.
Also, people get paid millions just to play fo(u)otball, and they don’t even need to win. Why is it a problem for someone to live comfortably by playing video games?
It’s still a lot of people’s jobs. You may not care, but some people do it for a living, and if more game companies do this, that’s a lot of people getting screwed out of their source of income. It’s like telling artists that they can’t do commissions because it’s of copyrighted material.
