I assumed Rainbow didn’t get hers a year ago simply because the blanket, or rather, mattress of snow was part of the plan, and she couldn’t commit involuntary with a giant snowball because it wasn’t a big ball of Dip. X3
That’s what royal pardons and diplomatic immunity are for!
American law has nothing to do with anything; Rainbow Dash nearly destroyed the Weather Factory in Cloudsdale, and there’s a bit more than “malicious mischief” involved in potentially wrecking the climate of an entire nation and possibly causing the deaths of hundreds of thousands through unplanned inclement weather (in a place where that essentially never happens and thus nopony is prepared for it) and starvation due to the associated disruption of agriculture.
Indirectly, obviously.
B: Dash would be guilty of malicious mischief, which is a felony in some jurisdictions, but pales in comparison to anything that Glimmer has done (burglary, attempted murder, false imprisonment, kidnapping, and potentially others). As for remorse, that is only a mitigating factor for the trier of fact to consider when determining the guilty party’s punishment. For the record, I was not convinced by Glimmer’s “apology” after she decided not to lock all dimensions of Equestria into various doomsday scenarios.
Considering Rainbow got literally zero punishment for badly damaging the weather factory (and she wasn’t even visibly remorseful, unlike Starlight), it’s evident that Equestria doesn’t work that way.
That would set a somewhat problematic precedent, given how often Friendship Horse and her pals have nearly destroyed Ponyville. And, y’know, the weather.
Spider dungeon is the best dungeon.
