I do know DA and other fan outlets have for decades had to deal with endless debates on how far copyright law should reach, which has also affected fan Flash and YouTube videos, and was the mane motivation for the creation of SOPA, also known as, the lazy solution… A parody of “The Final Solution”. Oh, whatever. X3
The biggest problem here isn’t written on legal terms, though.
This is just tasteless.
When a company makes money off of someone elses character, then it is automatically an ill intent. That’s like the definition of “ill intention”.
Again, they don’t own the character. And if they made them sign a contract that led to the actual creator losing all the legal rights on her OC, then this is just despicable, especially considering that it was a wish fulfilled by the Make a Wish foundation.
Just because something is backed up by a law doesn’t automatically make it right.
Other than that, I have no idea what this comment of yours is supposed to accomplish. What you wrote here is exactly what I’m criticizing and what needs to change.

An individual image is protected by international copyright, but ideas—such as characters—are not. One must trademark your characters if one wishes to protect those.
I am sure all of that was explained in an agreement that Alexis’ parents had to sign. I personally think it’s rather silly to assume ill intent.
Characters getting taken away from the creator is nothing new unfortunately. Walt Disney lost Oswald the Lucky Rabbit to Universal Studios this way. The creators of Superman never got any of the money from the famous character and lived the life of poverty.
There are certain rights that a creator holds over his creations. To not get said creations abused by a company is one of those rights. Especially in this Make a Wish Foundation case.
IF Hasbro indeed filed a trademark for Angel Wings, a character it does not own, for its own monetary gain, then this is just another example for how those laws need an overhaul, a quick one, at that.
Trademarking a character of someone else because the Make a Wish foundation convinced you of putting this character into your show for an episode doesn’t make it right to do that.
There is something fundamentally wrong with the system in place if your own character can get taken away from you and monetized by a company so easily.

Not really; once someone’s character appears in MLP—which is exceptionally hard to do—it stops being an OC and is an official character trademarked by Hasbro. My understanding that Hasbro has to approve all characters and designs. I don’t take this to mean the character gets “taken away from” the OC’s owner, just that once it’s official it’s fair game for Hasbro to license the character out however it wishes.
In other news, I think it’s cool that Angel Wings is appearing in the game, too! I think it’s neat that instead of just an episode, Angel Wings gets a little more love, too.
I prefer to be prepared for the worst. “Hope for the best, but be prepared for the worst.” is what I’m living by.
Oh, no doubt it happens, and there’s definitely a possibility that could be the case here. But, it’s kind of stupid to just automatically assume the worst like that.

Instead of writing passive-aggressive comments like this, you should better use Google. Companies doing awful things, including violating people’s rights, to gain money is something that happens quite often.

Hasbro doesn’t own Angel Wings, it has literally no rights to do this. And since Angel Wings was put into the episode because of the “Make A Wish” foundation, it is morally reprehensible if Hasbro really cashes in on Angel Wings.
This was supposed to fulfill a wish for a sick teenager, not to be an opportunity to fill Hasbro’s pockets.
Hasbro did a disgusting thing here if that money doesn’t go to Alexis Heule only.

It doesn’t even have any rights on Angel Wings, neither the name, nor the design, so it can’t just go and make money with her like that…..
Has Hasbro stooped so low now that it made the creator of that OC sign a contract to give it the intellectual rights on Angel Wings in exchange for getting her wish fulfilled? Because that’s nothing that happened with Stellar Eclipse during Season 4…..
If that money doesn’t go to Alexis Heule for charity reasons to support her (and I have the strong feeling it won’t, especially not with Gameloft), I’m calling huge yakshit on that corporate greed.

Eh, “croissants” is probably just a joke by Larson over Derpy being called “muffins” even though she is known as Derpy. With Cotton Cloudy maybe that is the case but they could easily change her internal name. There should be no problem with naming with Gameloft when they don’t really name ponies, like say Truffle Shuffle to “teachers pet”.
Dinky might be “Croissants” internally, though she and Brown Sugar are probably just numbers. And I figured it would be “Cloud” that would be the reserved part. If only we knew the internal names…
They could easily renamed her… Dinky does not even have her name and a bunch of other ponies, so they could of easily renamed or or called her cloudy filly or something.
I really wish somepony could contact them and see about bringing her actually into the game, cause a few actually do care about her.
