Either way what I'm saying is why are you here, yaknow? The fact remains that the auction was to win the picture as a YCH, and the artist uploaded the Base image. So with that in mind, they broke no rules regarding the YCH auction since again they're two separate pictures.
Following that, they can still decide to retry an auction for the YCH variation any time and you'd once more get the chance to try your hand at winning the auction.
Edit: Just checked the original auction link and its not listed as "Investigation for Fraudulent Activity" so even the site moderators agree its not a fraud.
