Fan-art is a bit of an exception to copyright laws. Basically, the same loophole that allows fans to draw pictures of ponies without fear of Hasbro suing their asses off allows Hasbro to “borrow” said works of fan-art for its own uses. It’s a sort of unofficial quid pro quo, with each side looking the other way.
And probably laziness.
Because here’s the thing:
making the vector already takes work.
It’d seem like a relatively small step to just switch the colors or tweak the poses ever so slightly and be invulnerable to this forever.
If somebody makes the vector but stupidly keeps the exact same elements in the item the vectored it off of? They still did work.
Should they have credited the source especially in a paying commission, yes yes yes.
I feel hesitant to call it a “steal” though because they still did vector work.
