We don’t know that for sure.
I remember Sega & Sumo Digital awhile back mistook a fanart piece for an official art, and used it in a game. (They removed it, and apologized to the fanartist with a neat giftbasket. Ironically, the artist wasn’t upset, and found the situation flattering.) Could be the people who work on the comic could’ve done the same mistake.
I also wouldn’t fault Fosgitt alone though, (which is quite biased) as the comic editor, and/or writer tell the artist what to draw, and could be equally, or more-so responsible.
Nobody cared when Hasbro started
stealing using fanon names for the background characters, (such as “Lyra”) or accused them of stealing from fans. (Granted, not like they could prove who came up with the names originally.) It could be a mistake, as I said.
Also, the mohawk helmets aren’t entirely original either, as the show already used them.
