No idea, i tend to go by the respect system. Like if you can do the original justice and use it creatively to make something new, go for it and credit the artist. If they ask you to take it down, its your fault for wasting time doing it before asking :P
If youre not comfortable with your ability to make something the original artist would enjoy/like, best to ask before hand either way. Thats my two bits
