Nonetheless, the juxtaposition here is completely okay and necessary.
afaik in USA law, fair use can only be declared in a court of law on a case by case basis. there is no objective criteria that defines fair use. “critique or commentary” might still be ruled guilty, depending on the material, and the whims of the jury and judge that day. fair use can never protect you from getting dragged to court, either.
fair use doesn’t matter anyway, if the mere threat of legal action makes them take down your stuff. that happens on youtube a lot
actually fair use is often actively banned on derpibooru. if you’re making fair use of another artist’s work, that’s an unauthorized edit, which the admins will ban if the artist asks.

I couldn’t, honestly. it may be an “edit” but not all edits are created equal. you have to have to be massively arrogant if you require permission before people can put things next to your work that you gave them.
In this case I could agree.
I think they’re complaining about whoever took pencil’s redrawing, and placed it next to the original. placing something next to a picture is technically “editing” it.
A complete redraw from ground up, with entirely different style, with entirely different scene layout and entirely different non-canon entities is not an “edit”.

Yes, this would fall under fair use. Also, we always delete full page uploads that aren’t official previews. If you see one that’s not a preview, please report it.

#1 Respect artists and their artwork
All edits of an original image not made by the original artist should be tagged as “edit”, and preferably should be made with the artist’s permission.
I bet that pencils don’t ask for the permission to edit this page.
Also this image literally show the scan of a full page that isn’t a preview
Sometimes it’s just a predetermined schedule, where you get the “technical plot” on a givenday day (X), and you’re supossed to have it done in X+N days.
I still think that more often than not, the style on official MLP comics is too simple, but it’s also obvious the difference of what you do as a job, that may not relly be your thing; against someone made out of interest on a fandom and with proper inspiration.
Still, more often than not, people speaks out of their arses.
considering that the mlp comic has multiple artists, the pace shouldn’t be all that grueling. jay probably made that tweet as an apology, either for procrastinating, or for other, non-comic related shenanigans taking up his time. I highly doubt he got a phone call along the lines of:
When discussing time…the only way for Pencils to be an artist for a company like IDW, with this amount of detail and style, is if he got a colorist to help. I’ve met with various different artists working in the industry who handles different areas of a comic. Writer, Layout Artist, Line artist, Colorist, etc. Multiple people are needed if they want to push out a super detailed comic in a short amount of time. The production rate of artwork Pencil pushes out isnt fast enough to do it solo. Yes he can absolutely do it, but is it fast enough for a 22 page comic in 6 days? Not to mention possible re-draws of sections or a whole page, as that happens too. Im not sure as I cant speak for him.
Overall, this does prove that Pencils can produce a specific style and level of detail of a comic. I can easily see him hired to do such work as a line artist. Does that make his less or more than Jay’s version? Not at all.
it’s triumphant rage! that’s a rare emotion! the eyes are slightly squeezed on the bottom from her wide open mouth. integrating the eyes and the nose/mouth is vital for expressions. her shoulder is pulled back from trying to turn around.
compare that with the expression on the bottom left panel of pencil’s one. her right eye is drawn over the bridge of her snout, her horn is pointing straight up, not at all forward, and her clenched teeth aren’t stretching her cheeks at all.
You call the bottom right panel a good expression?
Spike growing to fight off monsters is something that falls squarely within his capabilities, if they finally started giving him some attention and made it so he can grow by more positive emotions.
But no. Even though growing/becoming stronger is part of Spike’s abilities, they had to make it a spell by Starlight…
