Eh, in case of Sombra it wasn’t death penalty over some ‘taking over’. He just broke down the safety fence, ignored warning signs and trespassed into secure perimeter, then got killed by automatic defenses.
 
Getting fried by an electric fence while trying to climb it isn’t death penalty, it’s evolution.

To be fair, I’m pretty sure he could regenerate just from that horn. It took him a while to reassemble a physical body after being a shadow creature no reason he can’t do that again.
 
He is a being of magic now, twisted and evil.

My personal headcanon: King Sombra was long dead. What was left was his corruption, a parasitic, non-sentient organism of dark magic, that empowered Sombra while he was alive, and simultaneously drained life out of him, eventually killing the pony underneath, and inheriting only skeletal traces of shape and consciousness.

There’s also the fact that, unlike the Tree of Harmony, the Crystal Heart is powered by the thoughts and wishes of the Crystal Ponies. It takes their power and their wishes and magnifies them into a weapon.
 
And what did the Crystal Ponies want above all else when threatened by the return of the tyrant that enslaved them? They wanted him to die. Or at least go away and never return. The Crystal Heart took that wish and used its power to make it so.
