I know but like I said, it still looks bad for them just to be accused of stealing, also I doubt Hasbro would go through the trouble of starting up with any legal issues anyway.

Technically, because the FIM backgrounds are clear derivative works of MLPFIM, Hasbro does have a copyright claim on them, but so does the artist/Mane6. (All pony fanart is in the same boat). It doesn’t give Hasbro free right to “take” fanwork for their own, but if it really came down to a legal challenge, it would be very hard for the Mane6/artist to win.
But the fact that Twi’s pose is different? I’m guessing this is a planned sequence of header images leading up to something.

It most likely doesn’t matter if someone did or didn’t, it would still look bad if they are accused of stealing from someone so it may be better to just change it. May even look worse as they are accused of stealing from something Hasbro sent a C&D order to.
