Pony town is enough of its own thing to not be directly associated with MLP (I remember early on they had manes and tails that looked more in par with ones from the show that were eventually changed).
 
Them’s Fighting Herds is a direct result of a C&D. It has no relation to the MLP brand despite it’s origins because it came from a C&D from Hasbro.

Legal right my ass, these developers weren’t making money off Hasbro’s IP, the game was COMPLETELY FREE TO PLAY.  
Meanwhile out here, around the World, there are so many MLP bootlegs for sale that Have NO LICENSE from Hasbro and the people who product that crap MAKE MONEY off ‘em, but it appears that Hasbro doesn’t give a shit about that, because apparently destroying fan projects is way easier and has the priority

The problem with buying a license from Hasbro isn’t even so much that it’s expensive, it’s that they’ll just tell you straight up “No, you’re not allowed to do that for this project.” I’m expecting that to be the case here, but even if by some miracle it isn’t the case then you would get back to it being expensive.

The idea is that they go after projects that have substantial quality or longevity. If the project garnered enough notoriety, they’ll go after it because it’s taking attention away from their IP. I can understand the legal purpose of it, but if it’s a passion project produced by fans for a relatively small demographic (compared to that of the overall consumer base), they should overlook it as long as it doesn’t cut into their profits, whilst the project itself is not making a profit. Too many times in the past decade have good projects have gone without making a profit for their creators and gotten C&D’d for less. This one has some legal grounding because of Patreon, but plenty of others haven’t even come close and have gotten the banhammer.
 
Most other corporations have openly accepted a lot of their fan community developments, some of which growing to decades of appreciation that lead to greater longevity and more investors looking to buy into the company. Even the top-notch developments had paid staff to produce fan content, and have gotten nothing from the IP holders (see Sonic fandom, Trekkies, Star Wars fandom, etc). Capcom hasn’t gone after Mighty No. 9 yet, and they honestly don’t need to with how bad it bombed “like an anime fan on prom night.” A lot of fan projects that don’t have Nintendo or Hasbro’s IP’s have had successful runs and have led to the jump start of many careers, be it art design, game production, coding, music composition, sound design, storyboard writers, and many more.
 
The way the two corporations go about it is archaic at best, and crippling at worst. They look past the human element and only look at the minor instance of it being potentially good enough to sell a profit (even if the game is completely free to play with no DLC or “SURPRISE MECHANICS” to sell).

Hasbro is a multi-billion dollar conglomerate who’s primary directive is to sell merchandise with the intent for youth to consume and enjoy. To think they would sign off on a dating simulator with any of their IP’s is nothing short of a pipe dream. Remember, we’re in the good old USA. If they don’t see a reasonable income in a project that would follow certain moral guidelines, they won’t go for it. And it’s not like they don’t have the resources to put together something like that, it’s just that they have the resources to protect their image by going after projects that resemble the likeness of their IP all too well.
