I think its more of a constitution of fair use. If Shuxer was putting the original artists work on shirts / Badges, etc then that be a different story. Instead a reference is used and under his own power and skill, creates a 3d model, detailed and painted that now is considered its own artwork.
 
I think the artist’s would feel very flattered having their work brought to life in such a way, i mean its not like he’s not crediting them for the idea of the pose.

I can’t help but think it’s odd that he sells what is essentially NCmare’s original artwork. I wonder if NC gets any cut from the profits or really any artist that gets their artwork turned into a figure.
