In Swedish all vegetables and berries are all subcategories of fruits. This makes cucumber, paprika, strawberries all fruits.
 
Then there’s specific rules for what makes it a berry (still a fruit)… banana, melon and avocado are all berries.
 
Finally, there’s vegetables with no rules. What’s in this category is followed by common sense. Avocado, tomato and paprika is vegetables.
 
Tomato is a fruit, as it’s a vegetable, just like paprika.  
This also makes Avocado not only a fruit, and vegetable, but also a berry.

Tomatoes have about as much of a place in a fruit smoothie as they do in a fruit salad.

Thankfully that case was in 1893 AND about taxation. Any further down the road along with an arbitrary excuse would have caused me to be questioning about that Country’s Judicial System even more.
